TERMS OF SERVICE

1. Overview

These Terms of Service (“Terms”) govern your use of the Monumental Bronze website and any related services, products, or transactions (the “Services”).

By accessing this website or placing an order, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use the Services.

All sales are made directly with Monumental Bronze.

2. Eligibility & Account Information

You must be at least the age of majority in your jurisdiction to use this website or place an order.

You agree to provide accurate, complete, and current billing, shipping, and contact information. You are responsible for maintaining the confidentiality of any account credentials and for all activity under your account.

3. Products & Representation

Monumental Bronze specializes in bronze sculptures, including commissioned and made-to-order works.

We make reasonable efforts to display accurate descriptions, dimensions, finishes, and imagery. However:

Color and appearance may vary due to screen settings.
Natural variations in patina and casting are inherent to the lost-wax bronze process.
Dimensions and weights are approximate unless otherwise stated.

We reserve the right to modify or discontinue any product at any time without notice.

4. Orders & Acceptance

Submission of an order constitutes an offer to purchase.

Orders are not accepted until payment has been received and confirmed. We reserve the right to decline or cancel any order at our discretion.

For commissioned or special-order works, production begins only after payment has cleared and, where applicable, a written agreement has been executed.

5. Pricing & Payment

All prices are subject to change without notice.

Unless otherwise stated, pricing does not include applicable taxes or special delivery requirements.

Payment must be made in full (or in accordance with agreed deposit terms) before production scheduling begins.

You represent that you are authorized to use the payment method provided and agree to pay all charges incurred.

6. Commissioned & Special Order Works

Large-scale, made-to-order, and commissioned pieces are produced specifically for each client. any statue with dimensions greater than 27″ x 20″ in any direction are special order and non-refundable.

Because of the custom nature of these works:

Production timelines are estimates (typically 8–14+ weeks depending on scale).
All commissioned works are final sale once production has begun.
Cancellations after production scheduling may be refused or subject to administrative or restocking fees at our discretion.

7. Shipping & Risk of Loss

Delivery timelines are estimates and not guaranteed.

We are not responsible for delays caused by carriers, weather, customs, supply chain disruptions, or events outside our control.

Title and risk of loss transfer to the client upon delivery to the shipping carrier.

Clients are responsible for ensuring appropriate site access and conditions for delivery.

Installation services are not included unless expressly agreed in writing.

8. Returns (Non-Commissioned Items)

Eligible standard (non-commissioned) items may be returned within 14 days of delivery, provided:

The item is in original condition.
Return authorization has been issued in advance.
The client covers original and return shipping costs.

Commissioned and special-order works are non-returnable once production has begun.

9. Intellectual Property

All website content, including images, text, branding, designs, and layout, is the property of Monumental Bronze and is protected under applicable intellectual property laws.

You may not reproduce, distribute, or use any content without prior written permission.

10. Third-Party Services

Our website may include links to third-party services or tools. We are not responsible for the content, policies, or practices of third parties.

Shopify provides the e-commerce platform that enables transactions; however, all purchases are made directly with Monumental Bronze.

11. Disclaimer of Warranties

Except as expressly stated in writing, products and services are provided “as is.”

We do not guarantee that the website will be uninterrupted, secure, or error-free.

To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

12. Limitation of Liability

To the fullest extent permitted by law, Monumental Bronze shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Services or any purchased product.

Our total liability shall not exceed the amount paid for the product giving rise to the claim.

13. Indemnification

You agree to indemnify and hold Monumental Bronze harmless from any claims, damages, or expenses arising from your breach of these Terms or misuse of the Services.
